Terms of Service

Short version: I do the work we agreed on, to the standard we agreed on. You own what I build for you. Be straight with me and I'll be straight with you.

About TechPersona Studio

TechPersona Studio is operated by Thao Phuong, a sole proprietor based in Massachusetts. These terms govern the relationship between TechPersona Studio ("I," "me," "my") and clients ("you," "your") who engage services through this site or by direct agreement.

Services

I offer two core services:

  • Website design and development — custom websites built to match your brand, optimized for search and AI discovery, designed to convert visitors into customers.
  • Business automation — systems that handle missed calls, after-hours bookings, and customer follow-ups automatically.

The exact scope of any engagement is defined in a written proposal sent to you before work begins. That proposal, combined with these terms, forms our full agreement.

Free audit

The free website audit is provided at no cost and with no obligation to purchase. You submit your website URL; I return a short video and written notes within approximately 2 business days. This audit is an honest assessment, not a sales pitch. You can walk away after receiving it owing nothing.

Payments

Payment terms are set out in your proposal. Typical structure:

  • 50% deposit before work begins
  • 50% balance before final delivery or site launch

Invoices are due within 7 days of receipt unless otherwise agreed. Late payments may delay your project timeline. If payment is more than 14 days overdue, I reserve the right to pause work until the account is current.

Revisions

Each project includes a defined number of revision rounds specified in the proposal. Revisions mean changes within the agreed scope. New features, structural changes, or additional pages beyond the original scope are quoted separately.

What you own

Once final payment clears, you own the website and all custom code, copy, and design I created for your project. I retain the right to show the work in my portfolio unless you request otherwise in writing.

Third-party assets (stock photos, premium fonts, licensed plugins) remain subject to their original licenses. I'll tell you which assets have ongoing licensing requirements before we finalize.

What I need from you

To complete your project on time, I need:

  • Access to your existing website, hosting, or domain when relevant
  • Brand assets (logo, photos, color preferences) by the agreed date
  • Timely feedback during revision rounds
  • A single point of contact who can make decisions

If delays on your end push the project past the agreed timeline, the remaining balance may become due at the original delivery date regardless.

Cancellations and refunds

If you cancel after work has begun, the deposit is non-refundable. If I've completed more than 50% of the agreed work, the full project amount is due.

If I need to cancel (rare — only in cases of genuine emergency), I'll refund any payment for work not yet delivered and help you transition smoothly.

Results

I build websites and systems to the highest standard I know how. But I can't guarantee specific business outcomes — traffic, leads, revenue — because those depend on factors outside my control (your market, your offer, your follow-through). What I promise is quality work, honest advice, and full accountability for what I deliver.

Confidentiality

I treat your business information as confidential. I won't share your operational details, client lists, or internal numbers with anyone outside the project. I expect the same discretion in return regarding any proprietary methods or tools I share during our engagement.

Limitation of liability

My total liability for any claim related to a project is limited to the amount you paid for that project. I'm not liable for indirect or consequential losses — lost profits, lost customers, or business disruption — even if I was aware such losses might occur.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes are resolved in the courts of Massachusetts.

Changes to these terms

I may update these terms as my business evolves. Active project agreements are governed by the terms in place when the proposal was signed. The current version of these terms always lives at this URL.
